Terms of Service

1. Who we are
"TriCounty Permit Alerts," "we," "us," and "our" refer to the operator of the service available at tricountypermits.org. "You" means the person or business that signs up for and uses the service. These Terms are a contract between you and us; by signing up or using the service you agree to them.
2. What the service is
TriCounty Permit Alerts is an email digest service. Each morning we collect commercial building permits filed in the prior 24 hours from publicly available permitting portals operated by Henrico County, the City of Richmond, and Chesterfield County, Virginia. We filter that list according to your account preferences and email you the matching results.
We do not warrant that every permit issued by a county is captured, that the filtering is perfect, or that the email arrives at any specific time. We make a good-faith effort to deliver the digest before 7 AM Eastern, Tuesday through Saturday, on days when the county portals are operating normally.
3. Subscriber accounts
- You must provide a valid email address. We authenticate via email magic link — we don't store passwords.
- Your subscription is tied to a single business or individual. Sharing your digest with people outside your business is fine; reselling or republishing it is not.
- You're responsible for keeping your account email accessible. If you lose access to your email, contact us at [email protected] with proof of the underlying business.
4. Plans, trials, and billing
- We offer two plans: Basic ($49/month) and Pro ($99/month). Both are billed monthly in advance via Stripe.
- New subscribers get a 14-day free trial. A valid payment method is required at signup. You will not be charged during the trial. If you do not cancel before day 15, the plan you selected will renew automatically at the listed price.
- You can cancel anytime from your dashboard. Cancellation takes effect at the end of the current billing period; you retain access until then. We don't pro-rate refunds for partial months, but we will issue a refund for a clearly accidental renewal — just email us within 7 days of the charge.
- Prices may change. If they do, we will email you at least 30 days before the change takes effect on your account.
- You authorize Stripe to charge your payment method on the agreed schedule. Stripe is also the processor of record for any disputes.
5. Source data and accuracy
The permit data we deliver is sourced from the three counties' public portals. We do not collect, generate, or independently verify it. The counties may publish data that is incomplete, delayed, mistaken, or later corrected. We pass on what they publish.
You should treat each digest entry as a starting point, not a verified record. Always click through to the source link on the county portal to confirm details before making business decisions, contacting applicants, or expending resources.
6. What you may and may not do
You may use the digest, including its contents, for your own business purposes: lead generation, outreach, bidding, market research, and competitive analysis.
You may not:
- Resell, sublicense, or repackage the digest, or any substantial portion of its data, as a product or service to third parties.
- Use the service to harass, defraud, or harm the applicants, owners, or addresses listed in any permit.
- Attempt to access, scrape, reverse engineer, or interfere with our systems, beyond ordinary use of the digest itself.
- Use the service in violation of any applicable law — including, without limitation, fair-housing law, do-not-contact rules, and any state or local solicitation regulations.
7. Service availability
We aim for high reliability but do not guarantee uninterrupted service. We may experience outages or delays, particularly when county portals are themselves unavailable. We will not be liable for missed or delayed digests resulting from upstream portal failures, force majeure, scheduled maintenance, or routine technical issues.
8. Termination
You may stop using the service at any time by canceling from your dashboard. We may terminate or suspend an account if we reasonably believe you are violating these Terms, abusing the service, or putting our infrastructure at risk. Where practical we'll give you a heads-up before doing so.
9. Disclaimers
The service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and any warranty arising from course of dealing or trade usage.
Nothing in the digest is legal, financial, or professional advice. Permit data describes activity reported to government bodies and may be wrong, outdated, or subject to ongoing review.
10. Limitation of liability
To the maximum extent permitted by law, our total cumulative liability to you for any claim arising out of or relating to the service or these Terms is limited to the greater of (a) the amount you paid us in the 12 months immediately before the event giving rise to the claim, or (b) $100. We will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages — including lost profits, lost business opportunities, or lost data — even if advised of the possibility of such damages.
11. Indemnification
You agree to defend, indemnify, and hold us harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from (a) your use of the service, (b) your violation of these Terms, or (c) your violation of any third party's rights, including in your outreach to permit applicants.
12. Changes to these terms
We may update these Terms from time to time. If we make a material change, we'll notify active subscribers at least 30 days before the change takes effect. Continued use of the service after that means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Richmond, Virginia, and you and we consent to that venue.
